Standard Possession Order in Texas
When it comes to parenting time after divorce or separation, Texas law provides a starting point — the Standard Possession Order. Sims & Purzer helps parents protect their rights and their children’s best interests.
What Is the Standard Possession Order?
When parents in Texas separate or divorce, child custody (called conservatorship) and visitation (possession and access) must be determined.
Texas law presumes that the Standard Possession Order (SPO) is in the best interest of the child. The SPO is a court-ordered schedule that dictates when the noncustodial parent (possessory conservator) has parenting time.
At Sims & Purzer, we help parents understand how the Standard Possession Order applies — and whether modifications may better suit your family’s needs.
What Does the Standard Possession Order Include?
Under Texas Family Code, the SPO provides:
-
Weekends: 1st, 3rd, and 5th weekends of each month.
-
Thursday evenings: During the school year.
-
Alternating holidays: Such as Thanksgiving and Christmas.
-
Summer vacation: At least 30 days of extended time.
If the noncustodial parent requests, they may be entitled to an expanded SPO, allowing longer parenting time on weekends and Thursday overnights.
We help you evaluate what’s best for your child and advocate for a schedule that works for your family.
Is the Standard Possession Order Mandatory?
No. While Texas law presumes the SPO is appropriate, courts can deviate if:
-
The child is under 3 years old.
-
SPO is unworkable
-
The schedule is not in the child’s best interest.
At Sims & Purzer, we help parents request customized visitation schedules that reflect their child’s needs and the realities of their lives.
Expanded Standard Possession Order
An Expanded SPO allows the noncustodial parent additional time, including:
-
Longer weekend visits (starting Thursday evening and ending Monday morning).
-
Extended summer and holiday periods.
We guide parents through requesting or opposing an expanded SPO when appropriate.
